In reply to your letter of the 29th July, reference
53600/37, relating to the proposed Bill to amend the Hong Kong
Companies Ordinance 1932, I am directed by the Board of Trade
to state for the information of Mr. Secretary Ormsby-Gore
that the report of the Departmental Committee which preceded
the Companies Act, 1929, contained a recommendation that no
company should without the consent of the Board of Trade be
registered with a name including the words "Bank" or "Banking".
It was decided, however, not to give effect to this
recommendation, in view of the possibility that the consent of
the Board of Trade to the use of such words in a company's
name might be wrongly regarded by the public as implying
some sort of government guarantee. The Board of Trade are
not aware whether there are reasons for such a provision in
The Under Secretary of State,
Colonial Office,
S.W.1.
